Exclusive: U.S. accuses China of instigating plot against DuPont (Reuters)

SAN FRANCISCO (Reuters) ? Chinese government representatives directed a U.S. businessman to obtain valuable technology manufactured by chemical giant DuPont and U.S. authorities were seeking on Wednesday to keep him in jail ahead of his trial on charges relating to trade secret theft, prosecutors said in newly released court documents.

Walter Liew, a U.S. citizen, and his wife, Christina Liew, each were indicted last year by a Northern California grand jury on three counts, including witness tampering, making a false statement and conspiracy to tamper with witnesses and evidence, according to court documents.

A hearing on bail is scheduled for Walter Liew on Wednesday in U.S. federal court in San Francisco as prosecutors try to keep him behind bars.

According to court documents, Walter Liew paid at least two former DuPont engineers for assistance in designing chloride-route titanium dioxide, also known as TiO2. DuPont is the world's largest producer of the white pigment used to make a range of white-tinted products, including paper, paint and plastics.

Both Liew, 54, and his wife have pleaded not guilty. Liew was held without bail, while his wife was released, court documents show.

DuPont also filed a civil lawsuit against Liew for misappropriating trade secrets.

Liew denies obtaining or possessing "any confidential, proprietary trade secret materials" from DuPont regarding TiO2, according to court documents.

Last month, Liew's attorneys requested that a U.S. magistrate judge reconsider the decision to deny Liew bail. In the court filing on Tuesday, prosecutors argued for Liew's continued incarceration by listing his connections with Chinese officials.

Liew was hosted at a banquet in 1991 by Luo Gan, who at the time was a high-ranking official of the Communist Party of China Central Committee, according to correspondence from Liew that U.S. federal officials say they seized from his safety deposit box. Luo Gan went on to become a member of the nine-member Standing Committee of the Politburo, prosecutors wrote in the filing.

Several other Chinese officials also attended, according to the documents.

"The purpose of the banquet is to thank me for being a patriotic overseas Chinese who has made contributions to China," Liew wrote in a memo to a Chinese company, according to U.S. prosecutors, "and who has provided key technologies with national defense applications, in paint/coating and microwave communications."

Luo Gan gave Liew directives at the meeting, and two days later Liew received a list of "key task projects," including TiO2, prosecutors stated.

"DuPont's state-of-the-art technology is not available publicly and PRC (People's Republic of China) companies have not been able to master it on their own," prosecutors wrote. "Liew, however, obtained that technology from former DuPont employees and sold it to companies controlled by the PRC government."

In his court filing seeking bail, Liew denies he was invited to a banquet with some Chinese officials, but Luo Gan is not discussed. In seeking bail, Liew's attorneys note that was born in Malaysia and has lived in the United States for 32 years.

The Chinese embassy in Washington did not immediately respond to an e-mail seeking comment early on Wednesday.

LOS ANGELES ? Mike Kelley, the daring and influential contemporary installation artist who counted the band Sonic Youth and artist Paul McCarthy among his collaborators, has died, police said Wednesday. He was 57.

Kelley's body was found at his home Tuesday night and it appeared he had committed suicide, South Pasadena Police Sgt. Robert Bartl said, without providing further information on the death. An autopsy was pending.

The artist's death brings a tragic end to a career empowered by both a punk-rock rebelliousness and pop-culture kitsch. Kelley famously filled art spaces with sculptures and unorthodox objects, and his solo exhibit "Catholic Tastes" at the Whitney Museum of American Art in New York," which provocatively combined dolls, drawings and other objects, established him as a major figure in the art world in 1993.

"His work was widely collected and exhibited internationally," said Stephanie Barron, senior curator of modern art at Los Angeles County Museum of Art. "He had a voracious appetite for all kinds of art. He was enormously curious and worked incredibly at his craft. He was never afraid to think really big. Artists like that don't come around very often."

Bartl said authorities went to Kelley's home Tuesday after a concerned family friend went to the residence, and then called 911. The friend told investigators that Kelley had been depressed after recently breaking up with his girlfriend, but no note was found, Bartl said.

Kelley's work will be included in the upcoming 2012 Whitney biennial in New York.

In addition to "Catholic Tastes," other major solo exhibitions included 2004's "The Uncanny" at the Tate Liverpool in the United Kingdom and 2006's "Profondeurs Vertes" at the Louvre in Paris.

"Mike was an irresistible force in contemporary art," Kelley's studio, Gagosian Gallery, said in a statement that the Los Angeles Times published on its website. "We cannot believe he is gone. But we know his legacy will continue to touch and challenge anyone who crosses its path. We will miss him. We will keep him with us."

Kelley's notable works included a life-size re-creation of his childhood home on wheels, tiny rendition of Superman's extraterrestrial birthplace encased in a glass jug and several spherical sculptures made of stuffed animals.

"His works often violated notions of so called good taste and blurred the boundaries between art, music and popular culture," said Barron.

He erected a life-sized Colonel Sanders statue alongside a miniature Sigmund Freud at the Gagosian in Los Angeles in 2011 and was influenced by old yearbooks for a sprawling 2005 exhibition at the Gagosian Gallery in New York that featured a 15-foot-long missile called the "gospel rocket."

Kelley was a student of conceptual artist John Baldessari, and he collaborated with fellow bold artists like Paul McCarthy and Tony Oursler. The band Sonic Youth used Kelley's work on the album cover for "Dirty" released in 1992.

Born in Detroit, Kelley founded the band Destroy All Monsters with three other musicians in 1974. He left the band in 1978 to attend the California Institute of the Arts in Valencia, near Los Angeles, but never strayed far from the music scene, frequently contributing to music journals and always counting music as an inspiration.

"He was extremely intense, very serious, phenomenally well read. He would go very deep into his subjects, a real artist scholar but with a real passion for whatever he was investigating," Barron said.

After encounters with him, Barron said, "I always came away learning something new, thinking about things differently and in awe of his curiosity."

Although she corresponded with him in the last couple of weeks, the last time she saw him was a month ago.

"It's incredibly sad," Barron said. "It's hard to imagine somebody with the life force and intensity that Mike brought to bear is no longer with us. His impact will be seen with distance as all the more powerful and we'll have to begin to process this."

World markets rise as investors watch Europe (AP)

BEIJING ? World markets rose Tuesday as traders watched for a possible deal to cut Greece's debts and Japanese factory output rebounded.

Benchmark oil rose above $99 per barrel while the dollar fell against the euro and was unchanged against the yen.

Tokyo's Nikkei 225 rose 0.1 percent to 8,802.51 after data showed December industrial activity rose 4 percent over the previous month. Hong Kong's Hang Seng gained 1.1 percent to 20,383.3 and Seoul's Kospi was up 0.8 percent at 1,955.79.

In Europe, France's CAC-40 added 0.8 percent to 3,292.38, rebounding from a 1.6 percent loss Monday. Germany's DAX gained 0.5 percent to 6,473.96, reversing a 1 percent decline a day earlier. Britain's FTSE 100 rose 0.6 percent to 5,703.94.

Wall Street was also set to open higher, with Dow Jones industrial futures rising 0.4 percent at 12,649 and S&P 500 futures 0.4 percent higher at 1,313.80.

Traders watched Europe following reports Greece and its creditors were close to a deal to cut its debts. Also Monday, European leaders agreed on a new treaty meant to stop overspending and put an end to the region's crippling debt woes.

"Everyone is watching the European summit and how the Greek debt crisis comes out," said Jackson Wong at Tanrich Securities in Hong Kong. "The general atmosphere is to play a wait-and-see game."

China's benchmark Shanghai Composite Index was up 0.3 percent at 2,292.61 ahead of Wednesday's release of a key manufacturing index. Investors are hoping for a loosening of credit curbs if it shows activity is slowing amid lackluster global demand.

India's Sensex gained 1.5 percent to 17,109.30 while Australia's S&P/ASX 200 fell 0.2 percent to 4,262.70. Benchmarks in Taiwan, Thailand, Indonesia and India rose while Singapore and New Zealand fell.

European markets tumbled Monday on concerns Greece's financial problems might not be solved even if creditors agree to cancel part of its debt.

Under a tentative agreement, investors holding 206 billion euros ($272 billion) in Greek bonds would exchange them for bonds with half the face value. The replacement bonds would have a longer maturity and pay a lower interest rate. When the bonds mature, Greece would have to pay its bondholders only 103 billion euros.

Wall Street fell in early trading but Asian investors were encouraged after the Dow Jones industrial average recovered most of its losses to close down just 0.1 percent. The Standard & Poor's 500 lost 0.8 percent.

Borrowing costs for the most indebted European countries shot higher. The two-year interest rate for Portugal's government debt jumped to 21 percent after trading around 14 percent last week.

Portugal may become the next country "where default is a real possibility," said Martin Hennecke of Tyche Group in Hong Kong.

"The euro zone crisis is far from being fixed at all. Italy and Spain are effectively bankrupt as well," Hennecke said. "For Asia, that means there is huge uncertainty in terms of export markets."

The treaty agreed to Monday by all European Union governments except Britain and the Czech Republic includes strict debt brakes and is aimed at making it harder for violators to escape sanctions. The 17 countries in the eurozone hope the tighter rules will restore confidence in their joint currency.

Benchmark oil for March delivery gained 98 cents to $99.76 per barrel in electronic trading on the New York Mercantile Exchange. The contract fell 78 cents to end at $98.78 per barrel on the Nymex on Monday.

In currencies, the euro rose to $1.3207 from $1.3114 late Monday in New York. The dollar held steady at 76.25 yen.

New species of ancient crocodile discovered

ScienceDaily (Jan. 31, 2012) ? A University of Missouri researcher has identified a new species of prehistoric crocodile. The extinct creature, nicknamed "Shieldcroc" due to a thick-skinned shield on its head, is an ancestor of today's crocodiles. Its discovery provides scientists with additional information about the evolution of crocodiles and how scientists can gain insight into ways to protect the species' environment and help prevent extinction.

The discovery was published this week in the journal PLoS ONE (Public Library of Science).

"Aegisuchus witmeri or 'Shieldcroc' is the earliest ancestor of our modern crocodiles to be found in Africa," said Casey Holliday, co-researcher and assistant professor of anatomy in the MU School of Medicine. "Along with other discoveries, we are finding that crocodile ancestors are far more diverse than scientists previously realized."

Shieldcroc is the newest discovery of crocodile species dating to the Late Cretaceous period, approximately 95 million years ago. This period is part of the Mesozoic Era, which has been referred to as the "Age of the Dinosaurs;" however, numerous recent discoveries have led to some scientists calling the era the "Age of the Crocs," Holliday said.

Holliday identified Shieldcroc by studying a fossilized partial skull specimen, which was discovered in Morocco and held by the Royal Ontario Museum of Toronto for several years before Holliday analyzed it. By analyzing blood vessel scarring on the bone, Holliday determined that the crocodile would have had a structure on top of its head, resembling a shield. The dents and bumps on the bone indicate veins delivered blood to a circular mound of skin, something never before seen in a crocodile. He said the shield was likely used as a display structure to attract mates and intimidate enemies and possibly as a thermo-regulator to control the temperature of the animal's head.

Holliday compared Shieldcroc's skull to those of other crocodilians. By comparing slopes of various bones, he found that the new species had a flatter skull than other known species. With this information, he believes it is unlikely that Shieldcroc wrestled dinosaurs on or near the shoreline. Instead, Holliday said the fossil indicates that Shieldcroc had thin jaws, likely used to catch fish.

"We believe Shieldcroc may have used its long face as a fish trap," said co-author Nick Gardner, an undergraduate researcher at Marshall University, who collaborated with Holliday on the study. "It is possible that it lay in wait until an unsuspecting fish swam in front of it. Then, if it was close enough, Shieldcroc simply opened its mouth and ate the fish without a struggle, eliminating the need for strong jaws."

In addition, Holliday analyzed Shieldcroc's skull and brain to estimate the overall size of the reptile. He said scientists often use head size of an animal to estimate its total length. Using several parameters, Holliday and Gardner estimate that this specimen had a 5-foot long head and was 30 feet long.

"Scientists often estimate body size of crocodilians based on the size of the skull," Gardner said. "However, estimating the body size of Shieldcroc was difficult, due to the enormous size of the skull compared to other crocodilians. To make a size estimate, we compared several features of the bone to many different species."

Although Shieldcroc lived more than 90 million years ago, Holliday said scientists can use information about the animal to gain a better understanding of today's crocodiles. He said this insight grows in importance as humans encroach on ecosystems.

"Today's crocodiles live in deltas and estuaries, the environments put under the most stress from human activity," Holliday said. "By understanding how these animals' ancestors became extinct, we can gain insight into how to protect and preserve the ecosystems vital to modern crocodiles."

The Shieldcroc fossil studied by Holliday and Gardner is being returned to the Royal Ontario Museum, where it will be put on display later this year.
